Commercial motor vehicle driver exemption from ESA hours of work provisions

by Yosie Saint-Cyr, LL.B., Managing Editor at HRinfodesk.com---Canadian Payroll and Employment Law News

The Ontario government is proposing to exempt provincially regulated employee truck and bus drivers (employee commercial motor vehicle drivers) from the Employment Standards Act hours of work provisions. This exemption would only apply to employee commercial motor vehicle drivers that are subject to the Highway Traffic Act Hours of Service regulation.

Currently, employee commercial motor vehicle drivers are covered by both the Highway Traffic Act Hours of Service regulation and the Employment Standards Act hours of work provisions. The application of these sets of rules has led to regulatory burden for employers.

To ensure they have covered every possible situation, the government is holding a public consultation on the proposed changes and interested stakeholders can provide their comments by September 24, 2008.

Comments can be sent to the Ministry of Labour 12th Floor, 400 University Ave. Toronto, ON M7A 1T7 Fax: 416-314-5855.
