1. Progress of Government and Private Members' Bills (new and amended legislation).

Bill 15 - An Act to Amend the Workers' Compensation Act

This Bill amends the Workers’ Compensation Act to permit the Minister to appoint the chairperson of the Governance Council to a term not exceeding three years, and to reappoint that person so long as the reappointment does not result in a period of consecutive service exceeding six years. The length of service that the appointee previously had as a director of the Governance Council does not limit the term of his or her appointment as chairperson. The Bill received First Reading on June 16, 2008 and Second Reading on June 17, 2008. Link to Bill 15. Sent to Committee for review on June 17, 2008.

Bill 12-15(5), Garnishment Remedies Statutes Amendment Act

This Bill amends the Creditors Relief Act to provide that the wages or salary of a debtor may be garnished for a period of one year. Other incidental amendments are made to the Act in respect of this amendment. The Exemptions Act is amended to exempt 70% of a judgment debtor's wages or salary from garnishment, subject to a minimum amount that may be prescribed. The Territorial Court Act is amended to revise the provision relating to the Territorial Court's jurisdiction in garnishment proceedings to correspond to the amendments made to the Creditors Relief Act. First Reading June 1, 2006. Received Third Reading on October 24, 2006. Link to Bill 12 Received Royal Assent on November 2, 2006 and will come into force at a later date on proclamation.

BILL 6, Workers' Compensation Act

This Bill repeals and replaces the existing Workers’Compensation Act and makes consequential amendments to other Acts in order to clarify and extendentitlement to compensation when a worker suffers apersonal injury, disease or fatality arising out of andduring the course of employment. First Reading on March 16, 2007. Link to Bill 6. First reading March 13, 2007. Received second reading March 14, 2007 and sent to committee for review and possible amendments. Report tabled on August 21, 2007 and sent for third reading. Received third reading on August 22, 2007 and Royal Assent on August 23, 2007. Will come into force on April 1, 2008.

Bill 14, Employment Standards Act
 

This Bill replaces the Labour Standards Act, the Employment Agencies Act and the Wages Recovery Act with a single statute that fixes the standard and the maximum hours of work in a day and in a week, subject to certain exceptions, and provides entitlements to overtime pay, vacation pay and holiday pay, as well as to unpaid pregnancy leave, parental leave, sick leave, compassionate leave, bereavement leave and court leave. The minimum wage would be prescribed by regulation. The Bill received first reading May 15, 2007; second reading May 16, 2007 and was sent to the Standing Committee on May 16, 2007 for review and possible amendments. Link to Bill 14. The Committee tabled their report on August 16, 2007 and the Bill received third reading and passed on August 17, 2007. Royal Assent was given on August 23, 2007. Will come into force on April 1, 2008.

Bill 3 - An Act to Amend the Employment Standard Act

This Bill replaces the definition "week" in the Employment Standards Act; "week" means a period of seven consecutive days. Link to Bill 3. Received First Reading on February 8, 2008; second reading on February 11, 2008. Proceeding and received Third Reading on February 19, 2008 and Royal Assent on February 20, 2008.

Bill 12 - An Act to Amend the Human Rights Act

This Bill amends provisions of the Human Rights Act pertaining to the appointment of Commission members. Responsibility for hiring staff members is vested in the Director, and they become employees in the public service. Both the Commission and Director may appoint assistants and engage advisors. The Commission is empowered to make its own rules of procedure, and the annual reporting requirements of the Commission are simplified. The Board of Management is given a role in the making of certain regulations under the Act, and such regulations are to be made in consultation with the Commission and the Director. The Bill received First Reading on June 12 and Second Reading on June 13, 2008. Link to Bill 12. Reported from committee on June 18, 2008. Received Third Reading and Royal Assent on June 19, 2008.
