The Second Session of the 56th Legislative Assembly resumed sitting Tuesday, November 25, 2008.

1. Progress of Government and Private Members' Bills (new and amended legislation).

Bill 82, the Access to Information and Protection of Privacy Act

Bill 82, the Access to Information and Protection of Privacy Act, received first reading in the legislature on June 5, 2008. The new legislation would replace the existing Right to Information Act and the Protection of Personal Information Act to better protect personal privacy and make public bodies more open and accountable. The Act would provide a framework for how public bodies respond to requests for information. If enacted, the Act would come into force on a day to be fixed by proclamation. Link to Bill 82.

Bill 6, Modernization of Benefits and Obligations Act

The omnibus bill will overhaul more than 30 acts and regulations and extend benefits and obligations to same-sex common-law couples; the same benefits and obligations as opposite-sex common-law partners. Link to Bill 6. First Reading on November 26, 2008.

Bill 8, Public Interest Disclosure Act

The Bill sets out a process for any public servant to report suspected government wrongdoing, and provides job protection if an employee faces workplace reprisal. If enacted, this Act comes into force on July 1, 2008. First Reading November 28, 2007. Link to Bill 8. Second Reading December 4, 2007. Sent to Committee of the Whole on December 5, 2007. Received third reading on December 12, 2007. Received Royal Assent on December 21, 2007. This Act comes into force on July 1, 2008.

Bill 31, An Act to Amend the Pension Benefits Act

The Bill will allow same sex couple to receive pension benefits from their spouse. Link to Bill 31. First Reading December 19, 2008. The Bill received Second Reading on April 29, 2008. Also received Third Reading and Royal Assent on April 30, 2008. This Act or any provision of it comes into force on a day or days to be fixed by proclamation..

Bill 12, An Act to Amend the Workers Compensation Act

The Bill will make it easier for firefighters with cancer to get compensation. First Reading November 30, 2007. Link to Bill 12. Second reading December 14, 2007. Received third reading on December 19, 2007. Received Royal Assent on December 21, 2007. This Act or any provision of it comes into force on a day or days to be fixed by proclamation.

Bill 76, An Act to Amend the Industrial Relations Act

The Bill will add a common employer provision. This provision would provide the Labour and Employment Board with additional power to look behind the scenes of a corporate structure to determine if an employer established a new business for legitimate business purposes or to avoid collective agreement obligations. If the new business was created to avoid the terms and conditions of a collective agreement, the board would have the authority to issue a common-employer declaration applying the terms and conditions of the existing collective agreement to the newly created company.
